This privacy policy provides an overview of how the Company collects and processes your personal data and tells you about your rights under the EU General Data Protection Regulation (“GDPR”).

This policy describes the collection, use, maintenance, protection, and disclosure of personal information from users of www.Camsblue.com and its affiliated websites. It applies to data provided during registration, service purchases, content posting, and interactive services, regardless of the user's location, as well as to all data collected on the Platform. The Platform may contain links to third-party websites, plug-ins, services, social networks, and applications, enabling a third party to collect or share user data. Before using these websites, we recommend reading their respective privacy policies. By using our Platform, you consent to our practices for processing and storing personal data, as this policy outlines. The policy may alter periodically, so it is essential to check for updates frequently. Using our Platform after any modifications signifies your acceptance and consent.

Definitions. For this Privacy Policy:

Account means a unique account created for You to access our Service or parts of our Service.

The country refers to Cyprus.

Device means any device that can access the Service, such as a computer, a cellphone, or a digital tablet.

It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

The Website refers to Camsblue.

You mean the individual accessing or using the Service, the Company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

1. Who we are. Pointblue Ltd is a limited liability company, registered in the Republic of Cyprus under registration number HE 410737, having its registered office at Voukourestiou, 25 NEPTUNE HOUSE, 1st floor, Flat/Office 11 Zakaki, 3045, Limassol, Cyprus.

2. Data we may collect about you. Personal data refers to information that can be used to identify an individual, excluding anonymized data. Depending on the individual's status as a model or user, we may acquire, use, retain, and transfer various types of personal data from and about you that we have grouped as follows:

2.1. Identity data consists of personal information such as first and last names, stage names, usernames, social media identifiers, federal tax ID, valid government photo identification, date of birth, gender, consent forms, and media files.

2.2. Contact data includes billing address, email, and telephone numbers.

2.3. Financial data, including bank and payment card details, is stored in limited amounts. Payment processors store all data, and users are advised to review their privacy policies and contact them directly.

2.4. Transaction data consists of payment information, content, virtual currency, purchased services, and tips given to models on our Platform.

2.5. Technical data includes Internet Protocol (IP) address, login information, browser type, time zone settings, browser plug-in types and versions, operating system, Platform, and other device technology used to access our Platform.

2.6. Device data includes your mobile device type, unique device identifiers such as the IMEI number or MAC address, network information, operating system, browser type, time zone setting, and IP address, along with your mobile network information.

2.7. Content data refers to digital content created, broadcasted, performed, or uploaded to our Platform and any associated metadata provided with that content. It may disclose personal information about users, such as identifying information. We may also record conversations between models and Users.

2.8. Profile data includes personal information such as username, password, purchases, interests, preferences, feedback, and survey responses. Certain information may be considered "special" or "sensitive" in certain jurisdictions, and submitting such data consents to its processing.

2.9. Usage data includes information about how you use our Platform, products, and services.

2.10. The marketing and communications data includes your communication preferences as well as your preferences regarding receiving marketing from third parties and us.

We collect, use, and distribute Aggregated Data, such as statistical or demographic data, for any purpose. Aggregate data could be derived from personal data, but it is not considered personal data under the law because it does not disclose your identity directly or indirectly. However, suppose we combined or linked Aggregated Data with your data that can identify you directly or indirectly. In that case, we consider the combined data personal data and use it by our privacy policy. 

Unless voluntarily provided, we do not collect Special Categories of Personal Data, such as race, ethnicity, beliefs, private life, sexual orientation, political opinions, health, genetic and biometric data, and information about criminal convictions and offenses. 

3. How we collect data about you. We collect your data primarily through direct information provided through our Website and occasionally through authentication systems used for login. We use various methods to gather this information listed below.

3.1. When you create an account by completing our registration form;

3.5. When you interact with models or users through our interactive services;

3.6. When you enter a competition, promotion, feedback, or survey;

3.9. When you interact with our advertisements and applications on third-party websites and services, if those advertisements and applications contain links to this privacy statement.

We do not control third-party websites or their privacy statements, and clicking on their links may allow them to collect or share your data. We are not responsible for their privacy statements, applications, or content accessible from the Website.

4. Failing to provide personal data

If we need to collect the user's data for legal or contractual purposes, and you fail to provide it upon request, we may be unable to fulfill the contract, such as providing goods or services. In such cases, we may need to cancel your Service, but we will inform you if this happens.

If you fail to provide your data when requested for use as a Model on our Website. In that case, we may not be able to provide final approval or, if previously granted, may withdraw your approval and suspend your account operation.

5. How we use your personal data. We use your personal data to provide services, communicate, deliver marketing, enhance and personalize your experiences, and conduct other business operations. The personal data we collect include the following:

5.1. Identify you as a visitor, user, or model on our Platform.

5.2. Present our Platform and provide the requested information, services, and support.

5.3. We are committed to fulfilling our contractual obligations and enforcing our rights, including those related to billing and collections.

5.4. Verify your identity and age if you post content on or through our Platform.

5.5. Collect and pay the money you owe if you are a model.

5.6. Collect and recover money owed to us.

5.7. Fight or respond to credit card chargebacks.

5.8. Review before publication to ensure that it is lawful and does not otherwise violate the standards of the credit card association.

5.9. Engage in real-time monitoring and removal of content being streamed.

5.10. Monitor compliance with the Platform’s legal documents or for quality assurance purposes.

5.11. Comply with applicable law.

5.12. Respond to your inquiries related to support or other requests.

5.13. Fulfill the purposes for which you provided the data or that were described when it was collected.

5.14. Deliver targeted advertising, newsletters, and other information.

5.15. Promoting our Platform.

5.16. Notify you about changes to our Platform or services.

5.17. Enable or allow you to participate in our Platform’s interactive features, including video calls and text messages.

5.18. Ensure that we present our Platform content most effectively for you and your computer or device.

5.19. Administer our Platform and implement internal operations, such as troubleshooting, data analysis, testing, research, statistics, and surveying.

5.20. Improve our Platform, services, marketing, or customer relationships and experiences.

5.22. Assist law enforcement and manage contentious regulatory matters, investigations, and litigation.

5.23. Make suggestions and recommendations to you and other users of our Platform about goods or services that may interest you or them.

We may use personal data to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your data for these purposes without your consent, if you click on or interact with an advertisement, the advertiser may assume that you meet its target criteria. We may use non-personal data for any business purpose.

6. Disclosure of your personal data. Our privacy policy prohibits unrelated use or sharing of personal data without providing an opt-out option. However, we may disclose information about your use of services or the Website to third parties for legal reasons or contractual obligations. When disclosing personal data to service providers, they must comply with GDPR obligations, ensuring contracts bind them. We may share or disclose your personal data:

6.1. With any member of our corporate group, which means our subsidiaries, our ultimate holding Company and its subsidiaries, and our affiliates.

6.2. To our business partners, suppliers, service providers, sub-contractors, analytics, search engine providers, and other third parties we use to support our business. These providers assist with platform improvement, payment processing, government identification validation, email delivery, hosting, customer service, and marketing efforts. We may allow selected third parties to use tracking technology on our Platform to collect data about user interactions, analyze data, determine content popularity, and understand online activity.

6.3. The Company's data about Platform users may be transferred to a buyer or successor in case of a merger, divestiture, restructuring, dissolution, sale, or transfer of assets, including bankruptcy or liquidation proceedings.

8. Users and Models profile. Users and models are advised to be aware that all information provided on the Website is public and can be viewed by all unless otherwise stated. They must understand that they control the information uploaded on the Website and are responsible for any consequences arising from such information.

9. Your personal data use choices. We aim to offer you control over your personal data by implementing mechanisms that allow you to make choices about your information.

9.1. Tracking technologies and advertising. You can turn cookies on or off in your browser, affecting certain parts of the Platform's functionality. For more information on cookies, refer to Cookies and automatic data collection technologies.

9.2. Promotional offers from the Company. To prevent the Company from using your Contact Data for promotional purposes, you can turn off promotional offers in your account settings or email support@camsblue.com. You can request a promotional email omitted from future distributions if you receive a promotional email. This opt-out does not apply to information from purchases, service experience, or other transactions.

9.3. Third-party links. We do not control third parties' collection or use of your information for interest-based advertising, but they may offer options to prevent such practices. Our Platform may have links to partner networks, advertisers, and affiliates' websites or plug-ins enabling third-party features. These websites have their privacy policies, and we cannot accept responsibility or liability for their policies. Please check these policies before submitting personal data.

10. Accessing and correcting your personal data. The Platform emphasizes the importance of accurate and current personal data, and users can request access and correction of their information. They can access, review, and change their data by logging into the Platform and visiting their account settings page. To access, correct, or delete personal data, email support@camsblue.com. However, deletion requires deleting your user account. Requests may not be accommodated if we believe the change or deletion violates laws or legal requirements or negatively impacts the information’s accuracy. Deleted Content Data may remain viewable in cached and archived pages or due to other users' copying or storage. 11. Data security. We prioritize the security of your personal data by implementing physical, electronic, and administrative safeguards, storing it behind firewalls on servers, and encrypting payment transactions using SSL technology to prevent loss, misuse, and unauthorized access. The safety and security of your information are dependent on you. If you have a password for accessing certain parts of our Platform, keep it confidential and avoid sharing it with others. If you withdraw, we may not be able to offer you a specific product or Service. We will explain the impact to you at the time to help with your decision.

14. Our policy towards minors. The Platform does not target minors or knowingly collect personal data from individuals under (18) or the applicable age of majority in the jurisdiction from which the Website is accessed. If we become aware that a minor has provided us with personal data, we will take steps to remove such information and terminate that person’s account immediately. 15.3. Right to be erasure. You can request the deletion or removal of your personal data if there's no good business reason for processing it, if you've exercised your right to object to processing, if we've processed your information unlawfully, or if you need to erase your data to comply with local law. However, we may only sometimes be able to comply due to specific legal reasons.

15.4. Right to object. You have the right to object to processing your personal data if it is based on a legitimate interest or if it overrides your interests, rights, freedom, or legal claims. However, restricting processing may require suspending the services we provide to you. 

15.6. Right to data transfer. We process your personal data if you have given us information for a contract or have requested permission to do so. We will provide your personal data in a structured, portable format to you or a third party you choose. We cannot be held responsible for third parties using your account information, as their Agreement and privacy statement govern it.

15.7. Right to withdraw consent. We process your personal data with your consent, but if you withdraw your consent, we may be unable to offer you certain products or services. We will inform you if this is the case at the withdrawal time.

Personal data access and other rights are free, but a reasonable fee may be charged if the request is unfounded, repetitive, or excessive. To ensure data security, specific information may be requested to confirm identity and prevent disclosure. Further information may be requested to speed up the response. Responding to legitimate requests within one month is typically done but may take longer if the request is complex or multiple requests have been made. In such cases, we will notify you and keep you updated.

16. California privacy rights. The California Consumer Privacy Act of 2018 grants California residents certain rights regarding their personal information, subject to exceptions, as of January 1, 2020. Consumers have the right to:

  • Opt-out of the sale of their personal information, should we sell their personal information;
  • Be informed of specific information concerning our collection and use of their personal information;
  • Request that we delete certain personal information we collected from them;
  • Appoint an agent to exercise their rights provided for by the CCPA, provided that a duly executed notarized power of attorney is presented and provided that the agent has information deemed sufficient to allow us to verify the identity of the Consumer in question and to locate their information in our systems;
  • Not be subjected to discrimination for the exercise of these rights. We will only allow California residents to use our Service or provide a different level or quality of services for exercising any of their CCPA rights if permitted under the CCPA.

The Website does not sell personal information to third parties for monetary or other valuable considerations in the past 12 months. However, it may disclose certain information to third parties and corporate entities for services. 18. No error-free performance. This privacy policy does not guarantee error-free performance, but we will make reasonable efforts to comply and take corrective action if found. We are not liable for any incidental, consequential, or punitive damages related to this policy.
